The Association of Christian Financial Advisers has welcomed the Government’s decision to investigate payday loans.
The Office of Fair Trading is to investigate payday lenders amid claims that they are taking advantage of people in financial difficulty and providing loans without checking that borrowers can afford to repay them.
The ACFA is calling for legislation to cap interest rates.
The group outlined its concerns in a letter to Chancellor George Osborne last December in which it expressed “increasing dismay” over the manner in which payday loan companies were allowed to trade.
The letter criticised the “unfair and unreasonable” interest rates charged by lenders.
According to the Independent, the typical APR charged by a payday lender is 4,000%.
“These rates of interest are not dissimilar to those of a back street loan shark, but dressed up with a fancy website and slick paced advertising,” the ACFA stated in its letter.
“Many consumers are now using this easy access to credit as a form of roll-over credit, month by month, thereby racking up unaffordable debt at extortionate rates of interest.”
The ACFA is calling upon the Chancellor to introduce legislation to cap interest rates for all personal lending, including unauthorised bank overdrafts.
It wants to see APR capped at a maximum percentage above base rate and interest limited to a rate similar to that imposed on credit unions – currently 12 per cent.
The ACFA has asked the Government to urgently introduce a measure to limit interest rates in the forthcoming budget.
“We’re delighted the government has announced this review of so-called Payday loans,” said Chairman Aidan Vaughan.
“There should be no place for the extortion of the desperate and vulnerable.”

OFT Investigates Payday Loans Sector
The consumer watchdog has launched an “extensive” investigation into the payday loans sector on concerns that some payday lenders may be taking advantage of people in financial difficulty.
As part of the review by the Office of Fair Trading (OFT), 50 of the biggest players in the industry will face spot on-site inspections.
Increasing pressure on household finances has helped fuel the rise of short-term, high-interest lenders but the OFT is concerned that some people are being given loans without the proper checks being carried out.
It will investigate whether firms target people unsuitable for credit, or roll over the loans so that the charges escalate to the point where they become unaffordable.
The OFT’s director of consumer credit David Fisher said: “We are concerned that some payday lenders are taking advantage of people in financial difficulty, in breach of the Consumer Credit Act and not meeting the standards set out in our guidance on irresponsible lending. This is unacceptable.
“We will work with the trade bodies to drive up standards but will also not hesitate to take enforcement action, including revoking firms’ licences to operate where necessary.”
The regulator has already written to several financial trade bodies about concerns over payday lenders’ advertising standards after assessing 50 websites.
The Consumer Finance Association (CFA), which was one of the trade organisations contacted and represents several large payday lenders, said the OFT’s approach was “absolutely right”.
“We have to identify areas of mal-practice and stamp it out. We know that there are payday lenders around who are less than transparent in their advertising and do not carry out the right levels of financial checks, in fact some of them brag about that, but they are not and will never be members of the CFA,” chief executive John Lamidey said.
“Research shows that payday loans have a valuable role to play in today’s society and meet a real need for consumers who like the short term, limited nature of the loan and want to avoid borrowing larger amounts over long periods of time.
“So the OFT’s review, by clamping down on poor quality payday lenders, will be good for consumers and good for our industry.”
The Consumer Affairs Minister Norman Lamb has also welcomed the review.

European banks prepare for worst, hoard cash
Jan 20 (IFR) – European banks are preparing for a potential worsening of the region’s sovereign and banking crisis, with many firms stockpiling cash and cutting back on loans to new clients as they seek to protect themselves against a possible seizing-up of financial markets.
Faced with 650 billion euros of debt coming due this year – almost 40 percent of which matures before the end of March – lenders are choosing to build up a cash cushion to ensure they can cover redemptions, creating a squeeze on the wider economy in the process.
Such hoarding illustrates the nervousness of lenders even after the European Central Bank injected 489 billion euros of cash into the banking system in December. Cash deposits at the ECB have ballooned since then, reaching a record 528 billion euros this week – higher than after the Lehman Brothers collapse.
“The big concern is that things might get worse,” said Bernd Hartwig, treasury manager at Nord/LB. “Political decisions are taking too long and most banks are building up liquidity just in case something happens. They are very worried that a new crisis could be a bigger than 2008.”
System-wide hoarding is the reverse of what happened the last time central banks injected hundreds of billions of long-term money into the system. Then, banks moved quickly to put the money to work and generate returns, sparking bond and equity market rallies – and economic growth.
The US Federal Reserve almost trebled the size of its balance sheet to more than $2 trillion in the months after the collapse of Lehman Brothers, pumping cash into the banking system through programs such as the Term Auction Facility. The ECB grew its balance sheet by about a quarter in that time.
WAIT AND SEE
But this time round, many banks have taken the decision to wait. While some have paid off interbank loans – so boosting the cash reserves of creditor banks – and a handful have bought some domestic government paper, most are choosing not to commit new cash to assets or to lending.
“For many banks it’s all about survival and they have just bought more time for themselves with the ECB money,” said the treasurer of one of Europe’s largest banks. “None of the fundamentals have been addressed. People are in standby mode – you might need lots of liquidity at short notice.”
There are other factors at work, too. Banks face strict new capital and liquidity rules, and many are planning to shrink their balance sheets in order to meet those targets – not buy more. They also do not want to commit to new assets because selling out could prove difficult should conditions worsen.
“The problem is completely different from 2009,” said Elie el Hayek, global head of interest rates at HSBC. “Back then, a big proportion of the money went into assets. This time, banks cannot do that simply because they need to protect their capital and liquidity. They know any mark-to-mark losses will eat into those buffers so they don’t want to take the risk.”
PREMATURE OPTIMISM?
Recent market optimism might also be premature. Although recent sovereign bond deals have been well bid, bankers say buying in secondary markets has been weak, and that there are few signs of banks using fresh cash to buy up European government bonds.
The lack of demand in secondary markets is partly due to the stigma now attached to peripheral bonds. Investors and regulators have started to ask more questions about such exposures, with the European Banking Authority penalizing banks for holding Spanish and Italian bonds during recent stress tests. Italian 10-year bond yields have fallen slightly in recent weeks, but have not dropped below 6.3 percent since early December.
“Banks are coming under political pressure to buy in the primary market,” said Pavan Wadhwa, head of global interest rate strategy at JP Morgan. “Given the lack of demand in the secondary market for peripheral paper, we estimate the ECB would need to more than double its current pace of purchases of Italian and Spanish paper to stabilize markets at the longer end.”
On the funding side, a recent fillip in bank bond deals also masks deep underlying problems. Banks have raised more through unsecured bond issues in January than they did in the whole of the second half of 2011. But only the highest rated banks have been able to get deals done.
That leaves hundreds of other firms with debts coming due and no prospect of tapping private investors. At the ECB’s first three-year long-term refinancing operation in December, 523 banks collectively borrowed 489 billion euros. Bankers expect the February three-year LTRO to be popular too.
“The concurrent increase in deposits at the ECB is consistent with banks building up funds to replace maturing debt,” Fitch Ratings said in a report this week. “We expect the next three-year funding round in February to see a similarly high level of take-up.”
NEGATIVE CARRY
Although banks earn little by depositing cash at the ECB – a measly 0.25 percent – and so effectively lose money because they are paying a much higher rate to borrow the cash in the first place either from the central bank or privately, treasury officials and CFOs feel justified making those losses.
“Running a liquidity position is a cost,” said the treasurer at a bank facing one of the highest refinancing hurdles this year, who confirmed that the bank had tapped the ECB in December only to deposit the money right back there. “But taking cheap money from the ECB is going to increase your liquidity and placate investors and shareholders.”
High deposits at the ECB are not necessarily being made by the same banks borrowing from the central bank – although there is some anecdotal evidence of a handful doing that. Rather, high deposits are indicative of cash being hoarded on a system-wide basis.
For now, banks say they will sit on the cash until the larger problems are sorted. “Do I want new customers with high risk and low rates? I don’t think so,” said one treasurer.
If, however, confidence returns to the markets and banks become less fearful, a huge bounce in asset prices is possible. Some believe that the slow build-up of cash at the ECB creates the potential for a massive asset binge should nervousness ease and bank funding stabilize. The ECB balance sheet recently reached a record 2.7 trillion euros, the highest in its short history.

Acta S.p.A. (AIM: ACTA), the clean energy products company, is pleased to provide an update on the recent development of the business. The Company is also providing an update in relation to developments regarding a previous transaction undertaken by the Company in December 2010.
Business update
As is evidenced by recent announcements, the Company has seen continued success and commercial validation in the applications of its highly innovative hydrogen generator products and electrolyser stacks via commercial engagement with customers and partners. In addition to the previously disclosed agreements the Company has seen an increasing number of commercial enquiries and orders across its product range. The recent acceleration in product commercialisation clearly demonstrates the commercial viability of the Company‘s products and its growth prospects.
As announced on 22 September 2011, the Company has been seeking to finance the growth of its production activities through its current banking relationships as well as through the disposal of its remaining portfolio of photovoltaic consents and the collection of grant receipts and working capital receipts due on the completion of EPC photovoltaic installation contracts. Having made a careful review of the financial resources available to it from these sources, the Board has determined that the level of capital currently available will not be sufficient to finance the Company through to full profitability and cash breakeven, and has therefore decided to seek additional funds through alternative sources to finance the working capital requirements of the Company’s current commercial expansion. The level and form of this financing has not yet been fully decided but there is a likelihood that there will be a requirement to raise additional equity.
Past transaction update
The Board also wishes to provide an update in relation to a previous transaction undertaken by the Company in December 2010.
In December 2010, Acta completed the sale of ten photovoltaic authorisations at a value of €2.45 million to a group of Italian investors through Auditors Italiana S.r.l. and Ingefin S.r.l., two Italian investment companies (the “Investment Companies”). This sale was completed and paid in full in cash in December 2010. After an initial provision in the audited results for the year ended 31 December 2010, the revenue and cash proceeds of this sale were recognised in Acta’s Interim accounts to June 2011.
At the time of the sale Acta was itself planning to build, own and operate a portfolio of photovoltaic projects if it could raise the additional capital needed. In order that Acta would have access to a sufficiently large portfolio of photovoltaic consents for own development, Acta obtained a call option (the “Call Option”) under a separate agreement to repurchase the authorisations from the Investment Companies during the period up to April 2011, at Acta’s sole discretion, if it should choose to do so. Due to the subsequent upheavals in the Italian photovoltaic sector Acta was unable to finance and implement this strategy and the option was therefore allowed to lapse.
In granting the Call Option to Acta, the Investment Companies relied upon a separate agreement with Bertam S.r.l. (“Bertam”), a company controlled by Paolo Bert, Acta’s CEO and 35.3% shareholder in Acta, under which Bertam agreed to purchase any projects that were not built by the Investment Companies or repurchased by Acta under its Call Option. This agreement that Bertam entered into was in order that Bertam could itself build out the projects if Acta did not proceed to do so. This was not disclosed at the time.
Upon further review the Board has determined that the Bertam agreement, given the involvement of Bertam as a related party of the Company, and to the degree that it allowed Acta to obtain the Call Option, should have been disclosed at the time.
The Board has satisfied itself that the sale of the photovoltaic authorisations by Acta to the Investment Companies was made at the same price as that achieved by Acta on the majority of its authorisation sales during 2010, which involved projects of a much smaller size, and that the price therefore represented a fair market price. The Board is also satisfied that Acta has received substantial benefits from the sale and has not been adversely affected.
As a result of the legislative changes to the Italian photovoltaic sector introduced by the Romani decree in March 2011 and subsequent downturn in the Italian photovoltaic sector, the Investment Companies no longer intend to build the photovoltaic consents acquired and have taken legal action against Bertam to obtain payment of €2.9 million for the photovoltaic authorisations. Accordingly the financial situation of Bertam has been adversely affected by the agreement with the Investment Companies and the fall in value of Bertam’s investment portfolio which includes the Acta shares which Bertam holds. If the legal action against Bertam ultimately should prove to be successful and an alternative settlement cannot be reached, Bertam may be required to sell shares of Acta in order to settle the Investment Companies’ claim.
